& Trusts
It is important for everyone to make a will and take into account your own family, and personal and financial circumstances, and any possible tax implications. If a person dies intestate (ie. without making a will) then it is possible those you wish to benefit from your Estate might not. There are also further procedures, costs and delays involved.
We also have an experienced Executry department to administer a person’s Estate. We will obtain valuations, agree any tax liability, apply for Confirmation and ingather all the various items and distribute to beneficiaries in terms of the will (if there is one) If no will then we will advise you of the rules of intestacy as to whom should inherit.
Gordon Sommerville, who is a Director with Enable Trustee Service Ltd, has experience with Trusts, especially for parents wishing to make a provision on death to provide funding for children or young adults with long term learning difficulties.

We can offer comprehensive advice in relation to seeking guardianship and intervention orders for an adult with incapacity.
We can also arrange for you to grant a Welfare and Continuing Power of Attorney in favour of a member of your family or trusted friend or professional adviser to allow your Attorneys to make decisions when you are unwell or incapacitated on such matters as medical treatments and to deal with your financial and property matters.

Advice
Pomphreys have considerable experience dealing with issues of succession. We understand that dealing with administrative matters at such a time can be overwhelming. Because of this we offer a professional, dedicated, and sympathetic service which includes preparation of wills and appointment of Executries.
Our Solicitors and support staff run an experienced Executory Department to administer an individual’s Estate. We will obtain valuations, agree any tax liability, apply for Confirmation and ingather all the various items and distribute to beneficiaries in terms of the will, if there is one. If there is no will, we will advise you of the rules of intestacy as to whom should inherit.
We arrange everything in a discreet and professional way and in accordance with your wishes and instructions. If there is a will, we will take the executor through the process of winding up the estate. If there is no will, we will draft the appropriate petition for the appointment of an executor, and ensure that the estate is wound up in accordance with the laws of Scotland.
